Will of William Savill . . copied at the ERO -D/AMW 23/8/12,

This is the last Will and Testament of me William Savill of Great Dunmow in the County of Essex Farmer. I appoint my wife Susannah Savill and *Isaac Livermore of Old Park in the parish of Great Waltham in the said County Farmer Executrix and Executor of this my Will. I give and devise unto my said wife Susannah Savill all that my messuage or tenement and farm with the barns, stables, outhouses, lands, meadows and pastures thereto belonging called ***Aptonfield Farm, containing together by situation ninety acres, more or less, situate and being in Great Dunmow aforesaid and in **Barnston and *Great Waltham in the said County of Essex, being part Freehold and part Copyhold and now in my own occupation. And also all the Great Tithes of the Lands in Great Dunmow aforesaid and also all that my Cottage or double Tenement with the yards, gardens and appurtenances thereunto belonging situate on Hounslow Green in Barnston aforesaid or in any adjoining Parish and now in the several occupations of William Perry and **James Savill. And also all that my Cottage in two Tenements called Shoulder Hall with the yards, gardens and appurtenances thereto belonging situate in Barnston aforesaid and now in the occupation of John Poulter and William Chalk. And also all that my Cottage or double Tenement called ??utes with the yards, gardens and appurtenances thereto belonging situate at *North End in the parish of Great Waltham aforesaid and now in the occupation of Joseph Porter and Henry Hammond. And also all that my other Cottage or Tenement with the yards, gardens and appurtenances thereto belonging situate at North End aforesaid near the Butchers Arms Inn and now in the occupation of James Porter and Nathaniel Porter. And also all that my Barn and four acres, more or less, of land thereto belonging situate in Great Waltham aforesaid near the last mentioned Cottages and now in my own occupation. To hold the same several messuages or tenements ,cottages, farm and lands and tithes unto my said wife Susannah Savill and her Apigus for and during the time of her natural life, subject to the occupation by my said executors of such parts thereof as shall be in my occupation at the time of my decease and also subject to their receiving and applying the rents of all the said cottages during the time and as hereafter mentioned.

And, from and immediately after the decease of my said wife, I give and devise the said cottages or tenements in Great Waltham aforesaid, in the occupations of the said James Porter and Nathaniel Porter and the said barn and four acres, more or less, of land near thereto and now in my own occupation unto my reputed son, John Savill, and his heirs and apigus for ever, and from, and immediately after, the decease of my said wife or when my youngest son, Thomas Rolfe Savill, shall attain the age of 21 years, whichever event shall last happen.

I give and devise my said messuage or tenement, cottages, farm and lands and tithes in Great Dunmow, Barnston and Great Waltham aforesaid in the occupation of myself and my said tenants [ except the said cottages , barn and land as before devised to the said John Savill and his heirs] unto my said son Thomas Rolfe Savill, his heirs and apigus for ever, and, in case my said son Thomas Rolfe Savill shall die under the age of 21 years, then I give and devise the same last mentioned Hereditaments and Premises from and after the several deceases of my said wife and son unto my eldest daughter, Sarah Savill, her heirs and apigus forever but, subject nevertheless to the same messuage, farm and lands called Aptonfield Farm and the said tithes being held by my said executors and the rents of the said cottages being received by them during the time and for the purposes hereafter mentioned . I give and bequeath unto my said wife and the said Isaac Livermore all my household goods and furniture, cattle, corn, growing crops, farming stockand implements of husbandry, effects and personal estate, whatsoever and wheresoever, upon trust to continue to hold on and occupy my said farm and lands and to carry on my farming business during the life of my said wife or until my youngest child for the time being shall attain the age of 21 years and, during such time, shall and do receive the rents of my said cottages. And my will and mind is and I direct that my said wife shall during her life be maintained and clothed and that all my children under the age of 21 years shall be maintained, clothed and educated in a suitable manner, out of the profits of the said farm and lands and the rents of my said cottages, until the youngest of my said children for the time being shall attain the age of 21 years. And my will and mind also is that the expenses of the admission of my said wife to the copyhold parts of my said Real Estate shall be paid out of my Personal Estate.

I give and bequeath to my said reputed son John Savill and all my other children [ except my said son Thomas Rolfe Savill] a Legacy of £50, to be paid to them if and when they severally shall attain the age of 21 years, out of my personal estate. N.B He had 6 other children, all girls.

And my will further is that as soon as conveniently may be after the decease of my said wife or when my youngest child for the time being shall attain the age of 21 years, which shall last happen, all household goods and furniture, corn, growing crops, farming stock and implements of husbandry, effects and personal estate whatsoever shall be converted into money and, after payment thereout of all my just debts, my funeral expenses, the charges of proving this my will and the above mentioned legacies, I give and bequeath the residue thereof unto and equally between my said son John Savill and all my other children except my said son Thomas Rolfe Savill. And my will and mind is that if the said John Savill or any of my other children [ except my said son Thomas Rolfe Savill] shall die before his, her or their share or shares of my said Personal Estate shall become payable leaving any child or children lawfully begotten, that the share or Shares of him, her or them so dying shall go to such child or children respectively and be paid to such child or children respectively on his, her or them attaining the age of 21 years but, in case the said John Savill or any or either of my other children shall happen to die before his, her or their part or share of and in the said residue of my Personal Estate shall become payable without leaving any child or children lawfully begotten, then I give and bequeath the part or share of him, her or them so dying unto and equally among the survivor or survivors of them my said children, except the said Thomas Rolfe Savill but including the said John Savill, if more than one, equally and, if but one then to such one only.

And I further declare my mind and will to be that my cousin Mary Rolfe, who now lives and resides with me, shall continue to live in my said farm house and board with my family, as she does now, so long as as the said farming business shall be carried on by my said executors if she shall live so long. And my will and mind also is that my said executrix and executor or either of them died or either of their executors or administratives shall not be charged or chargeable with, or accountable for, any more of the said trust monies and premises than he , she or they shall actually receive or than shall come to his, hers or their hands bby virtue of this mywill nor with or for any loss therein which shall happen without his,her or their wilful default nor one of them for the other of them or for the acts, deeds, disbursements executors or administratives of the other of them but each only for his and her own respective acts, deeds, receipts and disbursements. And, also, that it shall and may be lawful for my said executrix and executor and their respective executors and administratives and every of them, in the firstplace, by and out of the trust monies and premises which shall come to their respective hands by virtue of this my Will, to deduct and reimburse to and for himself, herself and themselves respectively, all such loss, costs, charges and expenses as he, she or they, any or either of them shall sustain , expend or be put unto, in or about the execution of this my Will, or otherwise in relation thereto.

Then also: by the above named William Savill, the testator, for his last Will and testament in the presence , present at the same time, who at his request, in presence, and in the presence of each other, have subscribed our names as witnesses [the whole tenth line of the first sheet - the land tithes between the 25th & 26th lines of that sheet - the ? and Tithes at the top of the second ? and the words "and the said tithes" in the seventh and eigth lines of the second sheet being first underlined ]

2 signatures ?.Wade ? & Benjn Anderson . If indeed Wade is correct, he likely a relation of Mary Wade, the informant on his Sep.1843 d.c. But 1841C record for her almost invisible! And Benjn Anderson was also a witness on the 1848 Will of William's aunt, Mary Rolfe

The within named Susannah Savill and Isaac Livermore, the executrix and executor, were severally sworn to the truth and faithful execution of the within will - and they also made oath that the Personal Estate of the Testator does not amount to the sum of £600.

The testator died at Great Dunmow in the County of Essex on the 20th day of September 1843 & Susannah Savill of Great Dunmow, aforesaid widow, and Isaac Livermore, of Old Park in the parish of Great Waltham in the said County, are the Executrix and Executor of his Will

Proved the 6th day of December 1843 before the Revd. Thos. Francis Ha Clk Surrogate & by the oaths of Susannah Savill & Isaac Livermore, the execs, to whom admin was granted , they being first sworn duly to admin.

MY COMMENT.

*In 1841C, obviously mistranscribed, Isaac Livermore 20, farmer, with 1 female and 3 male servants, is living at North End Old Park Great Waltham, next door to the Butchers Arms. [ District 11, page 3]. James & Nathaniel Porter are living in the house the other side of the Butcher's Arms. And still in North Park, but seemingly many houses away [ District 11, page 6], is Henry Hammond, no mention of ?utes nor of Joseph Porter. In 1848 & in 1863, Isaac Livermore is listed in Whites Trade Directory as being a farmer[ but not the owner] at Barnston Hall, Barnston. he also voted in the 1847 General Election in Barnston, implying he did indeed own land there. By 1873, a Mrs Mary Smith was farmer, Barnston Hall.

**1841C for Barnston is too faded to decipher! But James Savill, wife Martha and 7 children are on page 2 District 11

***Aptonfield, not so named, just Onslow Green where William, Susannah and children are living is on the 1841 Great Dunmow Census, District 1, page 2 . . . . . . . . 1861C. Called Apton Hill G.D. District 5 page 5. No Savills there. Samuel Sweeting, retired farmer and various ag.labourers. Susannah & 2 daughters at New Street, G.D. District 4, page ??

Given that his wife Susannah did not die until 1880, effectively each of his children just received a legacy of £50 on coming of age. By 1861C, his eldest son, John Savill, is a mere agricultural labourer, and remains thus in 1871 and 1881. Although he should have received the cottages and land in Great Waltham after his mother's death in 1880.

Thomas Rolfe Savill did not benefit from a £50 Legacy on coming of age in 1863, but should have received Aptonfield and the Great Dunmow holdings upon his mother's death in 1880. It would seem to me that Thomas Rolfe Savill received much more in 1880 than did his elder brother, John Savill. But Thomas Rolfe Savill did not leave a Will [ that survived] upon his death in 1888.

The Will seems to stipulate that Aptonfield and his other holdings not be sold till Susannah's death, or of Thomas Rolfe Savill attaining 21, whichever the later. Thus I would have expected his wife & Isaac Livermore still to be running it until her death in 1880. But she seems to have left there by 1861 [ or even by 1848 when Mary Rolfe writes her Will ] - when I cannnot find Aptonfield nor Shoulder Hall mentioned . In 1861 she, Susannah Savill, is a landed proprietess, living New Street, Dunmow. Meanwhile Isaac Livermore, 45, is newly married, 3 infant children, at Barnston Hall, having 424 acres and employing 30 people

I have so far been unable to pinpoint the location of Shoulder Hall : in one census- 1881 - it seems to be in the centre of Barnston, on both sides of where John Savill was living, then in another census it is the next house to Aptonfields. This latter also seemed to have mysteriously vanished from later censuses!!, but then I did find it once as Apton Hill. And also saw it in 2011!
